Triple Talaq Debate: There’s chance for midway between Modernity & Islam

Triple Talaq Debate: Syed Mohammad Wali Rahmani, the general secretary of the All India Muslim Personal Law Board is adamant on the decision to let the triple divorce ritual persist. While the debate is being driven by the fallacious facts till now, the fact that there can be a midway is being overlooked.

The All India Muslim Personal Law Board(AIMPLB) is, however, steadfast on its decision and is not willing to give in to any modern plea. The decision of the Law Commission to implement a uniform civil code(UCC) on Thursday has invited the wrath of the Muslim Community as AIMPLB has said that the “Modi Government” has initiated a war against the Muslim Community. 

It further says that if UCC is implemented, it would threaten the “plurality and diversity” of the Indian masses as it would paint the masses in “one colour”. AIMPLB also announced that a campaign will be started to bring awareness in Muslim Sects.

Congress’s take on the matter

While BJP and Shiv Sena are in support of the UCC implementation, the opposition, Congress said that BJP was trying to “polarise” the Indian Communities because of the coming polls.

While Arif Mohammad Khan who had delivered a speech in the Lok Sabha in the defence of Shah Bano case says, “We should have better practices these days and only if the downtrodden are uplifted, can the Islamic tenants be said to have been followed and justice will be done”.

He also said that there is no question that ‘triple talaq’ negates both equality and dignity of Muslim women as human beings and citizens of India and can have no place in a civilised society. In fact, the Personal Law Board publication titled “The Compendium of Islamic Laws” itself describes this form of divorce as “talaq bidat”.

While the two different opinions are being flagged on the triple talaq row, the question that surfaces is that what is the opinion of the Muslim women on this matter? Are they willing to abide by the age-old Muslim system of triple talaq, or do they want to break it off?
